RETURN AND REFUND POLICY
This Return and Refund Policy applies to products sold by German Truck Works LLC, doing business as Torque Ranch Motors (“Torque Ranch Motors,” “TRM,” “we,” “us,” or “our”), and to certain return-related services provided in connection with our international forwarding and parts-sourcing operations.
This Policy must be read together with our Terms of Service, Shipping Policy, Privacy Policy, and any transaction-specific quote, invoice, return authorization, forwarding agreement, or written instructions.
Important: Different rules apply depending on whether:

TRM sold the product to the customer;
-
the customer purchased the product independently from a third-party seller and only used TRM for forwarding; or
-
the transaction concerns a TRM service, including forwarding, inspection, handling, sourcing, packaging, or related services.
Mandatory rights that cannot legally be excluded remain unaffected.
1. CONTACT AND RETURN AUTHORIZATION
All returns to Torque Ranch Motors require prior written authorization unless mandatory law expressly provides otherwise.
Do not ship a product back to TRM or any supplier before receiving return instructions.

TRM may require a Return Merchandise Authorization (“RMA”) before accepting a return.
Authorization to return a product does not itself guarantee that a refund will be approved.
2. PRODUCTS SOLD BY TRM – UNITED STATES VOLUNTARY RETURN POLICY
For eligible products sold directly by Torque Ranch Motors and delivered within the United States, TRM generally accepts voluntary return requests submitted within 14 calendar days after delivery, subject to this Policy.
This voluntary return policy does not create additional rights where a product is otherwise excluded and does not reduce any rights that applicable law requires.
3. VOLUNTARY RETURN ELIGIBILITY
Unless TRM approves otherwise in writing, an eligible voluntary return must:

Be unused

Be uninstalled

Be unmodified
-
Be in resalable condition
-
Show no mounting marks
-
Show no test-fitting marks
-
Show no signs of use
-
Show no programming or electrical connection
-
Be free from damage caused after delivery
-
Be returned in complete original manufacturer packaging

Include all hardware
-
Include all instructions
-
Include all manuals
-
Include all accessories
-
Include all labels
-
Include all promotional items originally supplied
-
Be packaged safely for return transportation
-
Be returned to the location specified in the RMA instructions
TRM may inspect returned products before approving any refund.
Products returned incomplete, damaged, used, installed, modified, or otherwise unsuitable for resale may:
-
be refused;
-
be returned to the customer at the customer’s expense;
-
receive a reduced refund; or
-
be subject to a permitted restocking or reconditioning deduction.
4. PRODUCTS GENERALLY EXCLUDED FROM VOLUNTARY RETURNS
To the maximum extent permitted by law, the following products are generally not eligible for a voluntary TRM return unless TRM expressly approves the return:

Made-to-order products

Personalized products

Clearance products
-
Closeout products
-
Products marked final sale

Products specifically marked non-returnable

Installed products
-
Used products
-
Test-fitted products showing evidence of fitment

Drilled products

Cut products

Welded products

Programmed products

Flashed electronic modules

Electrical or electronic components after connection, installation, programming, or use

Opened fluids

Opened chemicals

Lubricants

Coatings

Consumable products

Products missing packaging

Products missing hardware

Products damaged after delivery

Products restricted from return by the manufacturer or supplier

Core deposits and core returns are governed by the specific terms applicable to the product or transaction.
A product being “special order” does not eliminate a statutory consumer right where applicable law does not permit that right to be excluded.
5. CUSTOMER-SUPPLIED GOODS / FORWARDING GOODS – NO PRODUCT RETURN TO TRM
This Section applies when the customer independently purchases a product from:

RockAuto
-
eBay
-
A manufacturer
-
A U.S. retailer
-
A parts dealer
-
A distributor
-
A salvage yard
-
A recycler
-
A marketplace seller
-
A private seller
-
Any other third party
and has the product delivered to Torque Ranch Motors for forwarding or related services.
TRM is not the seller of Customer-Supplied Goods.
Accordingly:
Customer-Supplied Goods are excluded from TRM’s product return and exchange program.
TRM does not owe the customer:
-
an exchange of the underlying product;
-
a refund of the price paid to the third-party seller;
-
store credit for the underlying product;
-
replacement of the underlying product;
-
the seller’s warranty obligations; or
-
the seller’s return obligations.
The underlying purchase agreement remains between the customer and the original seller.
This remains true even if TRM:
-
receives the package;
-
opens the package;
-
photographs the product;
-
verifies a visible part number;
-
weighs the shipment;
-
measures the shipment;
-
repacks the shipment;
-
consolidates packages;
-
prepares customs documents; or
-
forwards the product internationally.
6. RETURNING CUSTOMER-SUPPLIED GOODS TO THE ORIGINAL SELLER
If a customer wants Customer-Supplied Goods returned to the original seller, TRM may agree to assist as a separate paid handling and forwarding service.
TRM is not obligated to accept such a request.
The customer is responsible for determining whether the original seller accepts the return.
The customer must provide, where applicable:

Return authorization
-
RMA number
-
Seller return address
-
Return instructions
-
Required reason for return
-
Seller-generated documentation
-
Any required return label
-
Deadline information
TRM will not submit false defect claims, false shipping-damage claims, false warranty claims, or inaccurate return reasons to obtain a return authorization.
A return can be refused if:
-
The original seller refuses the return
-
The return deadline has expired
-
The required authorization is unavailable
-
The goods have already left TRM
-
The product cannot safely be shipped
-
Export or transportation restrictions apply
-
The seller requires conditions that TRM cannot reasonably satisfy
-
The goods are prohibited or restricted
-
Required documentation is missing
TRM does not guarantee that the original seller will:
-
accept the return;
-
waive a restocking fee;
-
refund the purchase price;
-
pay return transportation;
-
replace the product; or
-
honor a warranty.
7. COSTS OF RETURNING CUSTOMER-SUPPLIED GOODS
Unless another party has expressly agreed to pay the applicable charges, all costs associated with returning Customer-Supplied Goods are the customer’s responsibility.
These may include:

Return-label costs
-
Insurance
-
Packaging
-
Repacking
-
Labor
-
Handling
-
Palletization
-
Crating
-
Freight charges
-
Liftgate charges
-
Address-correction charges
-
Duties
-
Taxes
-
Brokerage fees
-
Customs charges
-
Seller restocking fees
-
Storage
-
Other transaction-specific charges
TRM may purchase or provide a return label for convenience.
Providing a return label does not mean TRM is paying for the return.
TRM may require payment for the label before shipment or, where legally and contractually permitted, charge or deduct the actual label cost and authorized return-related charges.
8. VOLUNTARY RETURN SHIPPING FOR PRODUCTS SOLD BY TRM
Unless otherwise approved in writing or required by applicable law, the customer is responsible for return shipping costs for voluntary returns.
TRM may provide a prepaid return label for convenience.
When the return is customer-paid, TRM may:
-
charge the label cost separately;
-
require payment before issuing the label; or
-
deduct the actual label cost from the approved refund,
where permitted.
Customers may also be permitted to arrange their own return transportation if specifically authorized by TRM.
Any customer-arranged return must use:
-
a trackable service;
-
appropriate packaging;
-
adequate insurance where appropriate; and
-
the exact authorized return destination.
TRM is not responsible for customer-arranged return shipments that are lost, misdirected, delayed, or damaged before reaching the authorized return location, except where applicable law provides otherwise.
9. ORIGINAL SHIPPING AND OTHER NON-RECOVERABLE COSTS
For voluntary returns, the following charges are generally non-refundable to the extent permitted by law:

Freight charges

Expedited-shipping charges

Special-delivery charges

Handling charges

Packaging charges

Crating charges

Palletization charges

Customs expenses already incurred

Duties or taxes not recoverable by TRM

Special-order costs

Non-recoverable payment or processing costs where legally permissible

Services already performed
Mandatory statutory refund rights remain unaffected.
10. RESTOCKING FEES
Approved voluntary returns may be subject to a restocking fee of up to 20% when permitted, including when:
-
A manufacturer charges a return fee
-
A supplier charges a restocking fee
-
Packaging has been opened
-
Packaging has been damaged
-
The product requires inspection
-
The product requires repackaging
-
The product requires reconditioning
-
The product is not returned in factory-new condition
-
TRM incurs a non-recoverable supplier return charge
TRM will attempt to communicate an expected restocking fee during return authorization when reasonably possible.
A restocking fee is not imposed merely because a German consumer validly exercises a statutory withdrawal right where such a fee would be prohibited.
Where legally permitted, a reduction for actual diminished value may instead apply under the rules described in the Germany Consumer Supplement.
11. INSPECTION OF RETURNED PRODUCTS
All returned products may be inspected before a refund is approved.
TRM may compare:

Photographs

Original shipment records
TRM may deny or reduce a voluntary refund where:

A different product was returned
-
A serial number does not match
-
Components are missing
-
The product has been used
-
The product has been installed
-
Damage occurred after delivery
-
Unauthorized modifications were made
-
The condition materially differs from the authorized return description
-
The return does not comply with the RMA instructions
Fraudulent returns may be refused and may be reported where appropriate.
12. REFUNDS
Approved refunds are normally processed after the returned product has been received and inspected.
Internal refund processing normally takes approximately 5–10 business days after inspection, although unusual transactions may require additional review.
Refunds are normally issued to the original payment method.
The payment provider, bank, card issuer, PayPal, Shopify, or other payment service may require additional time before funds appear in the customer’s account.
TRM may issue a partial refund where permitted if the product has suffered a reduction in value or the return does not meet the conditions for a full voluntary refund.
TRM may deny a voluntary refund when the return is not eligible under this Policy.
Mandatory statutory refund requirements remain unaffected.
13. EXCHANGES
Exchanges require prior approval and are subject to availability.
TRM is not obligated to hold replacement inventory while a return is in transit.
In many cases, the fastest process is:
-
complete the authorized return; and
-
place a separate new order for the replacement product.
Customer-Supplied Goods are not exchangeable through TRM because TRM did not sell those goods.
14. DAMAGED, MISSING, OR INCORRECT PRODUCTS SOLD BY TRM
Customers should inspect shipments immediately after delivery.
Visible shipping damage, missing products, missing components, or incorrect products should be reported to TRM as soon as possible and preferably within 48 hours after delivery.
Customers must preserve:

All packaging
-
Shipping cartons
-
Protective packaging
-
Pallet or crate where applicable
-
Shipping labels
-
Photographs
-
Freight documentation
-
Delivery receipt
Do not install, modify, program, discard, destroy, or return a damaged or incorrect product until instructions are provided.
For freight or LTL shipments, visible damage should be noted on the carrier delivery receipt whenever reasonably possible.
Failure to report promptly or preserve evidence may impair or prevent recovery from the carrier and may affect voluntary claim assistance to the extent permitted by law.
A reporting period does not eliminate mandatory legal rights that cannot lawfully be shortened.
15. INBOUND DAMAGE TO CUSTOMER-SUPPLIED GOODS
When Customer-Supplied Goods are purchased independently and shipped from the original seller to TRM, TRM is not the seller and generally is not responsible for:

Seller packing errors
-
Wrong products
-
Missing products
-
Counterfeit products
-
Prior damage
-
Concealed damage
-
Loss before delivery to TRM
-
Carrier damage occurring before TRM receives the goods
These issues must generally be pursued by the customer with:
-
The original seller;
-
the inbound carrier; or
-
another responsible party.
TRM may document visible damage discovered at receiving but does not guarantee that every concealed defect or transportation-related problem will be identified.
TRM’s receiving inspection is not a technical or mechanical inspection.
16. OUTBOUND TRANSPORT DAMAGE – FORWARDING SHIPMENTS
Transportation is performed by independent carriers.
Carrier liability is governed by:
-
Applicable transportation law
-
Carrier terms
-
Carrier liability limits
-
Declared-value rules
-
Insurance coverage, if any
-
Carrier claim procedures
Customers must inspect an international forwarding shipment immediately upon delivery.
If loss or damage is suspected, the customer must:
-
preserve all packaging;
-
preserve the shipping label;
-
photograph the exterior packaging;
-
photograph interior packaging;
-
photograph the damaged goods;
-
document missing items;
-
retain delivery paperwork; and
-
report the incident promptly.
Where the carrier permits the recipient/customer to make a claim directly, the customer is responsible for pursuing the claim directly with the carrier.
Where TRM is the contractual shipper or carrier-account holder and the carrier accepts claims only from TRM, TRM may submit or assist with the claim after the customer supplies all required documentation.
TRM does not guarantee that:
-
the carrier will accept liability;
-
the carrier will approve the claim;
-
the carrier will reimburse the full product value;
-
the carrier will reimburse duties or taxes;
-
the carrier will reimburse labor or consequential losses; or
-
the claim will be resolved within a particular time.
TRM’s assistance with a carrier claim does not constitute an admission that TRM caused the damage.
Any independent liability of TRM for TRM’s own legally actionable conduct remains unaffected.
17. DECLARED VALUE AND TRANSPORT INSURANCE
A declared shipment value does not necessarily constitute all-risk transportation insurance.
Separate cargo or transportation insurance exists only when specifically confirmed for the applicable shipment.
Carrier recovery may be limited by:

Applicable transportation law
Customers shipping especially valuable, rare, irreplaceable, discontinued, or used parts should ask about available additional coverage before shipment.
18. ORDER CANCELLATIONS AND CHANGES
Orders cannot necessarily be canceled through self-service.
Contact TRM immediately to request:

TRM will attempt to assist, but voluntary cancellation is not guaranteed.
An order generally cannot be voluntarily canceled after it has:

Been submitted to a supplier

Been purchased from a supplier

Entered fulfillment

Been allocated

Been prepared for shipment
-
Been shipped
-
Been specially manufactured
-
Become non-cancellable under supplier terms
Where legally permitted, an approved voluntary cancellation may be reduced by actual non-recoverable costs including:

Supplier cancellation charges

Freight

Special-order charges

Payment-processing costs
-
Other transaction-specific costs
Mandatory statutory withdrawal rights remain unaffected.
19. SERVICES, FORWARDING FEES, AND INTAKE DEPOSITS
Payments for:
-
Forwarding intake
-
Inspection
-
Sourcing
-
Handling
-
Packaging
-
Repacking
-
Consolidation
-
Documentation
-
Freight preparation
-
Customs preparation
-
Other services
are payments for services and are not treated as a product return.
Where TRM charges a forwarding intake deposit, the deposit is treated according to the applicable forwarding terms and is credited against the applicable later forwarding invoice where expressly stated.
A service fee may become earned as services are performed.
Services already fully or partially performed are not voluntarily refundable merely because the customer later decides not to continue the transaction.
This Section is subject to mandatory statutory withdrawal rights applicable to consumers, including the Germany Consumer Supplement below.
20. REFUSED DELIVERY, FAILED DELIVERY, AND RETURN-TO-SENDER
If a shipment is:
-
refused by the recipient;
-
undeliverable;
-
returned because of an incorrect address;
-
returned because duties or required amounts were not paid;
-
returned because the customer failed to cooperate;
-
returned after repeated failed delivery attempts,
the customer may be responsible for all resulting costs to the extent permitted by law.
These may include:
-

Carrier surcharges

Storage
-
Brokerage
-
Customs charges
-
Re-export
-
New packaging
-
Redelivery
-
Handling
-
Duties or taxes not recoverable by TRM
A returned shipment is not automatically a refundable order.
TRM will determine the available options after the shipment is physically recovered and all resulting costs are known.
21. INTERNATIONAL RETURNS
International product returns require prior written approval.
International returns may involve:

Export from the destination country

Re-import into the United States

Customs paperwork

Brokerage
-
Duties
-
Taxes
-
Special carrier restrictions
-
Freight
-
Additional packaging
-
Inspection
Unless required otherwise by mandatory law or expressly agreed by TRM, the customer is responsible for these costs.
TRM does not guarantee that duties, taxes, or other government charges previously paid will be recoverable.
22. BUSINESS CUSTOMERS
For Business Customers, voluntary returns are permitted only with prior written approval.
To the maximum extent permitted by law:
-
TRM may refuse voluntary business returns.
-
Return shipping is the Business Customer’s responsibility.
-
Supplier charges may be passed through.
-
Restocking fees may apply.
-
Special-order products may be non-returnable.
-
Shipping and freight charges are non-refundable.
-
Returned goods may be subject to inspection before credit.
-
Credits may be applied to the customer account rather than refunded where agreed.
Any separate written B2B agreement controls over this Section where inconsistent.
23. GERMANY CONSUMER SUPPLEMENT
ZUSATZBESTIMMUNGEN FÜR VERBRAUCHER IN DEUTSCHLAND
Dieser Abschnitt gilt zusätzlich, wenn der Kunde Verbraucher mit gewöhnlichem Aufenthalt in Deutschland ist.
Soweit eine Regelung dieser Policy einem zwingenden deutschen Verbraucherrecht widerspricht, gilt gegenüber dem Verbraucher das zwingende Recht.
23.1 Gesetzlicher Widerruf ist von einer freiwilligen Retoure zu unterscheiden
TRM unterscheidet ausdrücklich zwischen:
-
einer freiwilligen Rückgabe nach den freiwilligen TRM-Rückgaberegeln;
-
einem gesetzlichen Widerruf;
-
einer Reklamation wegen eines Mangels; und
-
einer Rücksendung selbst gekaufter Forwarding-Ware an einen Drittverkäufer.
Diese Verfahren haben unterschiedliche rechtliche Voraussetzungen.
23.2 Gesetzliches Widerrufsrecht
Soweit für einen Fernabsatzvertrag ein gesetzliches Widerrufsrecht besteht, beträgt die gesetzliche Widerrufsfrist grundsätzlich 14 Tage nach Maßgabe der anwendbaren gesetzlichen Vorschriften.
Für den gesetzlichen Widerruf ist keine Begründung erforderlich.
Der Verbraucher muss lediglich eindeutig erklären, dass er den Vertrag widerrufen möchte.
Die Einzelheiten ergeben sich aus der gesonderten TRM-Widerrufsbelehrung und dem Muster-Widerrufsformular.
23.3 Rücksendekosten beim gesetzlichen Widerruf
Soweit gesetzlich zulässig und der Verbraucher hierüber vor Vertragsschluss ordnungsgemäß informiert wurde, trägt der Verbraucher die unmittelbaren Kosten der Rücksendung der Ware im Falle eines gesetzlichen Widerrufs.
TRM kann dem Verbraucher auf Wunsch ein Rücksendelabel zur Verfügung stellen.
Soweit die Rücksendekosten vom Verbraucher zu tragen sind, kann TRM:
-
den tatsächlichen Labelpreis berechnen;
-
vorab Zahlung verlangen; oder
-
soweit rechtlich zulässig und transparent vereinbart, den tatsächlichen Rücksendepreis mit dem Erstattungsbetrag verrechnen.
Bei Waren, die aufgrund ihrer Beschaffenheit nicht normal per Post zurückgesendet werden können, erhält der Verbraucher die gesetzlich erforderlichen Informationen zu den Rücksendekosten beziehungsweise deren Schätzung.
23.4 Kein Rückgabegrund beim gesetzlichen Widerruf
Die in dieser Policy verlangte Angabe eines Rückgabegrundes gilt für:
-
freiwillige Retouren;
-
technische Reklamationen;
-
Garantieanfragen;
-
RMA-Verfahren; und
-
Drittverkäufer-Retouren.
Sie ist keine Voraussetzung für die Wirksamkeit eines gesetzlichen Verbraucherwiderrufs.
23.5 Wertverlust nach Nutzung oder übermäßiger Prüfung
Bei einem gesetzlichen Widerruf kann der Verbraucher nach den gesetzlichen Voraussetzungen für einen Wertverlust der Ware verantwortlich sein, wenn der Wertverlust auf einen Umgang mit der Ware zurückzuführen ist, der zur Prüfung ihrer Beschaffenheit, Eigenschaften und Funktionsweise nicht erforderlich war, und der Verbraucher ordnungsgemäß über sein Widerrufsrecht informiert wurde.
Insbesondere können je nach Produkt erhebliche Wertverluste entstehen durch:

Installation
-
Programmierung
-
Lackierung
-
Bohren
-
Schweißen
-
Schneiden
-
Befüllen mit Flüssigkeiten
-
Betrieb im Fahrzeug
-
Verschmutzung
-
Beschädigung
-
Verlust von Verpackung oder Zubehör
Ob und in welcher Höhe Wertersatz geschuldet ist, richtet sich nach den gesetzlichen Voraussetzungen des Einzelfalls.
23.6 Sonderbestellungen
Die bloße Bezeichnung eines Artikels als „Special Order“ beseitigt ein gesetzliches Widerrufsrecht nicht automatisch.
Soweit jedoch eine gesetzliche Ausnahme vom Widerrufsrecht besteht, insbesondere bei einer Ware, die nach Kundenspezifikation angefertigt oder eindeutig auf persönliche Bedürfnisse zugeschnitten wurde, kann das gesetzliche Widerrufsrecht ausgeschlossen sein.
Der Kunde wird hierüber vor Vertragsschluss informiert, soweit erforderlich.
23.7 Mängel an von TRM verkaufter Ware
Hat TRM die Ware selbst an den Verbraucher verkauft und bestehen gesetzliche Mängelrechte, bleiben diese vollständig von den freiwilligen Retourenregeln getrennt.
Im Rahmen einer gesetzlichen Nacherfüllung trägt TRM diejenigen erforderlichen Aufwendungen, insbesondere Transportkosten, die TRM nach zwingendem Recht zu tragen hat.
TRM kann verlangen, dass die Ware zum Zweck der Prüfung und Nacherfüllung zur Verfügung gestellt wird.
Der Kunde sollte deshalb eine angeblich mangelhafte Ware nicht ohne Abstimmung:
-
entsorgen;
-
zerstören;
-
weiterverkaufen;
-
irreversibel verändern; oder
-
auf eigene Initiative international zurücksenden.
23.8 Transportschäden bei von TRM verkaufter Ware
Bei einem Verbrauchsgüterkauf richtet sich der Gefahrübergang nach dem zwingenden gesetzlichen Verbraucherrecht.
Diese Policy soll das gesetzliche Transportrisiko nicht unzulässig auf den Verbraucher verlagern.
Der Verbraucher sollte dennoch jeden erkennbaren Transportschaden unverzüglich dokumentieren und TRM melden, damit TRM:
-
den Carrier kontaktieren;
-
Beweise sichern;
-
eine Carrier-Reklamation einleiten; und
-
die gesetzlich geschuldete Lösung bearbeiten kann.
Die Mitwirkung an einer Carrier-Reklamation beschränkt die gesetzlichen Ansprüche des Verbrauchers gegen TRM nicht.
23.9 Selbst gekaufte Ware / Forwarding-Ware
Hat der Verbraucher die Ware selbst bei RockAuto, eBay oder einem anderen Drittverkäufer gekauft, ist TRM nicht Verkäufer dieser Ware.
Ein Widerrufs-, Rückgabe-, Gewährleistungs- oder Erstattungsanspruch hinsichtlich des Kaufvertrags über das Teil ist daher grundsätzlich gegenüber dem ursprünglichen Verkäufer geltend zu machen.
TRM übernimmt gegenüber dem Verbraucher keinen Produkt-Umtausch und keine Erstattung des Kaufpreises für diese selbst gekaufte Ware.
Möchte der Verbraucher die Ware zum Verkäufer zurückschicken, kann TRM die Rücksendung gegebenenfalls als separate, kostenpflichtige Dienstleistung durchführen.
Die Rücksendekosten sowie sonstige dadurch entstehende Kosten trägt der Verbraucher, soweit nicht der Verkäufer oder eine andere verantwortliche Partei diese übernimmt.
23.10 Inbound-Transportschäden bei Forwarding-Ware
Wurde eine selbst gekaufte Ware bereits auf dem Weg vom Drittverkäufer zu TRM beschädigt, liegt die Klärung grundsätzlich im Verhältnis zwischen:
-
Verbraucher;
-
ursprünglichem Verkäufer; und
-
dem für die Eingangssendung zuständigen Carrier.
TRM kann erkennbare Schäden dokumentieren und Informationen zur Verfügung stellen, übernimmt jedoch nicht die Verkäuferpflichten des Drittverkäufers.
23.11 Outbound-Carrier-Schaden bei Forwarding
Wird eine Forwarding-Sendung beim internationalen Carrier beschädigt oder geht sie verloren, muss der Kunde den Schaden unverzüglich dokumentieren.
Kann der Empfänger die Carrier-Reklamation unmittelbar selbst einreichen, ist der Kunde für die Durchführung der Carrier-Reklamation verantwortlich.
Kann die Reklamation aufgrund des Carrier-Vertrags ausschließlich durch TRM als Versender oder Account-Inhaber eingereicht werden, wird TRM die Reklamation nach Vorlage der erforderlichen Nachweise einreichen oder angemessen unterstützen.
Die Entscheidung über Anerkennung und Höhe der Carrier-Entschädigung trifft der Carrier nach den geltenden Vertragsbedingungen und gesetzlichen Vorschriften.
Eine eigene gesetzliche Haftung von TRM wegen einer von TRM zu vertretenden Pflichtverletzung bleibt hiervon unberührt.
23.12 Dienstleistungen und Forwarding Deposit
Bei Dienstleistungen wie:

Forwarding
-
Teilebeschaffung
-
Prüfung
-
Verpackung
-
Umpacken
-
Konsolidierung
-
Dokumentenaufbereitung
kann der Verbraucher ausdrücklich verlangen, dass TRM bereits vor Ablauf der gesetzlichen Widerrufsfrist mit der Leistung beginnt.
Widerruft der Verbraucher anschließend nach einem wirksamen vorzeitigen Leistungsbeginn, kann TRM unter den gesetzlichen Voraussetzungen Wertersatz für die bis zum Widerruf bereits erbrachte Leistung verlangen.
Bei vollständiger Erbringung einer entgeltlichen Dienstleistung kann das Widerrufsrecht unter den gesetzlichen Voraussetzungen vorzeitig erlöschen, sofern die gesetzlich erforderlichen Erklärungen des Verbrauchers vorliegen.
23.13 Keine freiwillige Erweiterung zwingender Rechte
Diese Policy gewährt deutschen Verbrauchern:

die ausdrücklich beschriebenen freiwilligen TRM-Rechte; und
-
die zwingend gesetzlich bestehenden Rechte.
Aus einem gesetzlichen Anspruch in einem bestimmten Fall entsteht kein allgemeines freiwilliges Rückgabe-, Umtausch- oder Kostenübernahmerecht für andere Fälle.
24. CONFLICT BETWEEN POLICIES
If another TRM policy or transaction-specific document expressly provides a more specific rule for a particular transaction, that specific rule applies to the extent legally permitted.
Mandatory consumer law always prevails where it cannot legally be modified.

The policy version properly applicable when a transaction was concluded remains relevant to that transaction as required by law.
