SHIPPING POLICY
This Shipping Policy applies to shipping, delivery, forwarding, freight, export, packaging, and related transportation services provided or arranged by German Truck Works LLC, doing business as Torque Ranch Motors (“Torque Ranch Motors,” “TRM,” “we,” “us,” or “our”).
This Policy must be read together with our Terms of Service, Return and Refund Policy, Privacy Policy, applicable quote or invoice, forwarding terms, and any transaction-specific written instructions.
Different rules may apply depending on whether:

TRM sold the goods to the customer;

the customer purchased the goods independently and uses TRM only for forwarding;

the transaction is a domestic U.S. shipment;

the transaction is an international shipment;
-
the customer is a consumer or a business customer.
Mandatory rights that cannot legally be excluded remain unaffected.

3. PRODUCT AVAILABILITY AND ORDER PROCESSING
Product availability may change between the time an order is placed and the time it enters fulfillment.
In-stock, supplier-stocked, special-order, made-to-order, backordered, oversized, hazardous, international, and freight products may have different processing requirements and timeframes.
Orders placed on weekends or holidays generally begin processing on the next applicable business day.
An automated order confirmation acknowledges receipt of the order.

4. PROCESSING TIMES, TRANSIT TIMES, AND DELIVERY ESTIMATES
Processing times, transit times, estimated carrier times, and estimated delivery dates are estimates unless TRM expressly confirms otherwise in writing.
A carrier service described as “Express,” “Worldwide,” “Expedited,” or similar identifies the applicable carrier service and does not by itself constitute a TRM guarantee of delivery on a specific date.

Where applicable law gives a customer rights because delivery does not occur within an agreed or legally required timeframe, those rights remain unaffected.

6. SPLIT SHIPMENTS
An order may be divided into multiple packages or shipments.
Products may ship:

Separate tracking information may be provided when available.
The fact that one customer purchase generates multiple packages does not necessarily mean that each package represents a separate customer purchase or forwarding order.

Large, heavy, oversized, irregular, hazardous, palletized, crated, or LTL/freight products may require:

TRM may require a manually reviewed freight quote.
8. ADDRESS ACCURACY
Customers are responsible for providing complete and accurate delivery information.
This includes, where applicable:

Contact TRM immediately if an address needs to be changed.
An address change is not guaranteed after fulfillment or shipment preparation has begun.
To the extent permitted by law, the customer may be responsible for additional costs caused by materially incorrect or incomplete address information supplied by the customer, including:

9. TRACKING
Tracking information is provided when available after a shipment has been dispatched.
Carrier systems may require time before displaying the first scan.
Some freight shipments may use:

Bills of lading

Other tracking methods
A tracking status displayed by a third-party carrier is maintained by that carrier and may not update in real time.
10. DELIVERED OR MISSING PACKAGES
Customers should monitor tracking and arrange secure receipt of valuable, oversized, freight, or signature-required shipments.
If a shipment is shown as delivered but cannot be located:

check the delivery location;
-
check with household members, employees, neighbors, reception areas, mailrooms, or receiving departments where appropriate;
-
contact the applicable carrier promptly; and
-
notify TRM.
TRM may provide available shipment information and reasonable claim assistance.
Whether a replacement, refund, carrier payment, or other remedy is available depends on:

Whether TRM acted only as a forwarding provider

The applicable carrier contract

11. DAMAGED, MISSING, OR INCORRECT SHIPMENTS
Customers should inspect shipments promptly after delivery.
Visible transportation damage, shortages, missing components, or incorrect goods should be reported as soon as reasonably possible.
Prompt reporting helps preserve carrier evidence and claim rights.
Customers should retain:

Do not discard shipping materials while a transportation claim is under review.

Any requested reporting timeframe does not eliminate rights that applicable mandatory law does not permit TRM to limit.

Approved changes and cancellations remain subject to the Terms of Service, Return and Refund Policy, and applicable non-recoverable costs.
Mandatory consumer rights remain unaffected.
13. INTERNATIONAL SHIPPING SERVICES
TRM provides separately reviewed international services for eligible goods and destinations, including services directed toward Germany.
Standard product checkout may remain limited to U.S. addresses unless international checkout is specifically shown as available.
International customers may instead use:

An international transaction is accepted only after TRM has sufficient information to evaluate the applicable:

TRM may decline any international shipment that cannot reasonably, safely, economically, or legally be completed.
14. CUSTOMER-SUPPLIED GOODS / FORWARDING SERVICE
A customer may independently purchase goods from:

A U.S. retailer

A dealer

A distributor

A salvage yard

A recycler

A marketplace seller

A private seller

Another third party
and have those goods delivered to TRM.
In this situation:
TRM is not the seller of the underlying goods.
TRM provides only the agreed forwarding and related services.
The purchase contract for the goods remains between the customer and the original seller.
Receiving or forwarding the goods does not cause TRM to assume responsibility for:

Seller promises

Product authenticity

Product condition before receipt

Hidden defects

Seller fitment advice

Missing seller components

Seller warranties

Seller return obligations
unless a particular loss was caused by a legally actionable breach of TRM’s own obligations.
15. FORWARDING ORDER AND MULTIPLE INBOUND PACKAGES
A single customer purchase may arrive at TRM through multiple packages and tracking numbers.
For example, one purchase from a seller may be shipped from multiple warehouses.
Where permitted by the applicable forwarding order, all qualifying packages from that same customer purchase may be associated with one TRM forwarding order.
A new and separate customer purchase may require a new forwarding order.
Customers must provide tracking information as reasonably required to enable TRM to identify and associate inbound packages.
16. INBOUND PACKAGE IDENTIFICATION
Customers using TRM Forwarding must follow the delivery instructions provided for their forwarding order.
This may include use of:

Supporting purchase documentation
TRM is not responsible for delay caused by a customer’s failure to include or provide information reasonably necessary to identify a shipment.
TRM may place unidentified or disputed goods on hold until ownership or assignment can be verified.
17. AUTHORIZATION TO OPEN AND INSPECT FORWARDING GOODS
By using the Forwarding Service, the customer authorizes TRM, where reasonably necessary to perform the service, to:

Identify visible part numbers

Compare visible goods to submitted information

Measure goods

Weigh goods

This is not a technical, mechanical, authenticity, or fitment inspection unless such inspection has been separately agreed in writing.
TRM does not guarantee discovery of concealed defects.
18. REPACKING AND CONSOLIDATION
TRM may consolidate packages where TRM reasonably determines that consolidation is:

Operationally appropriate

Carrier-compliant

Customs-compatible
-
Economically sensible
TRM is not required to consolidate goods.
Packages may remain separate where consolidation would:

Increase damage risk

Create excessive weight
-
Exceed carrier limits

Mix incompatible products

Create customs complications
-
Affect hazardous-material requirements
-
Require unsuitable packaging
-
Increase transportation or handling risk
Safety and regulatory compliance take priority over reducing the number of packages.
Original seller packaging is not guaranteed to be preserved.
19. FINAL PACKED DIMENSIONS
International transportation is rated using the final transport-ready shipment, not merely the dimensions of the underlying part.
Final shipment dimensions may include:

Therefore:
Part dimensions are not necessarily shipping dimensions.
For example, an engine shipped on a pallet is rated using the completed palletized shipment rather than the engine alone.
20. ACTUAL WEIGHT AND DIMENSIONAL WEIGHT
Carriers may calculate transportation charges using actual weight, dimensional weight, volumetric weight, or other carrier rating methods.
The applicable billable weight may therefore be higher than the physical scale weight.
TRM uses the final shipment information reasonably required for the selected carrier service.
21. INTERNATIONAL SHIPPING CALCULATOR
Any public TRM international shipping calculator is provided for planning and estimation purposes.
Unless expressly stated otherwise, the calculator is not a binding freight offer.
The estimate may be based on customer-entered information, including:

Packaging

Palletization

Crating

Customs-related services

Estimated or calculated duties and taxes

Other agreed services
The amount charged to the customer is a TRM customer price.
It does not represent or promise disclosure of TRM’s underlying carrier contract rate, internal costs, supplier pricing, or margin.
23. CARRIER RERATING AND MANDATORY ADDITIONAL CHARGES
Carriers may rerate a shipment before or after tender where shipment data differs from the information originally used to obtain a rate.
Examples include:

Remote-area surcharge

Dangerous-goods charge

Oversize handling

Freight reclassification

Additional handling

Government or customs-related charges
Before dispatch, if a material carrier cost or mandatory shipment charge increases beyond the basis of the approved transaction, TRM may place the shipment on hold and request authorization or payment of a revised amount where permitted by law.
TRM is not required to absorb additional costs caused by materially inaccurate customer information or mandatory third-party charges that could not reasonably have been included in the original calculation.
24. CUSTOMS INFORMATION
International shipments may require information including:

25. COUNTRY OF ORIGIN
The country from which a product is purchased or shipped is not necessarily the same as the product’s country of origin.
A product purchased in the United States may have been manufactured in another country.
TRM may request or research origin information when reasonably required.
Where origin cannot be reasonably verified, the shipment may be held until the issue is resolved.
TRM does not guarantee that a customs authority will accept a particular origin determination.
26. CUSTOMS CLASSIFICATION
TRM may prepare or assist with customs classification based on available product information.
The final legal authority regarding:

remains with the applicable government authority.
A customs authority may independently reclassify or reassess a shipment.
A government correction does not by itself establish that TRM breached the contract.
27. DDP / DUTY-PAID SHIPMENTS
Where the applicable TRM quote or shipping documentation expressly identifies a shipment as DDP, Duty Paid, duties/taxes paid, or an equivalent duty-paid service, TRM will arrange the shipment on that stated basis using the verified information reasonably available at the time.
DDP or duty-paid treatment is not promised unless it is expressly confirmed for the particular shipment.
TRM does not guarantee that a government authority will:

Accept the original classification
-
Accept the stated origin
-
Accept the declared customs value
-
Refrain from requesting additional documents
-
Refrain from reassessing duties or taxes
-
Clear the shipment without inspection or delay
Any additional assessment caused by materially false or incomplete customer-supplied information may be charged to the customer to the extent permitted by law.
28. CUSTOMS AND GOVERNMENT DELAYS
Customs clearance times are controlled by government authorities and related service providers.
TRM does not guarantee:

Same-day customs clearance

Clearance within a specific number of days
-
No physical inspection
-
No documentation request
-
No government reassessment
A customs delay does not automatically constitute a failure by TRM to provide the forwarding service.
29. DUTIES, TAXES, VAT, AND IMPORT CHARGES
International shipments may be subject to:

Import VAT

Taxes

Brokerage

Government assessments

Carrier disbursement charges

Other import-related costs
Where such costs are included in a TRM quote, this will be reflected in the applicable customer transaction.
Where they cannot reasonably be determined in advance, the customer will be informed that additional charges may apply as required by applicable law.
30. ENGINES, TRANSMISSIONS, AXLES, AND FLUID-CONTAINING COMPONENTS
Used or new components including:

Transmissions

Transfer cases

Differentials

Axles

Steering components

Hydraulic components

Fuel-system components
may require special preparation.
Such goods must be safe and suitable for transportation.
TRM may require:

Additional inspection

Special carrier approval
Visible oil, fuel, coolant, hydraulic fluid, or other transportation-risk residue may require corrective preparation.
TRM may place the shipment on hold until the condition is resolved.
Material additional preparation costs will be handled according to the applicable transaction and customer authorization requirements.
31. BATTERIES, AIRBAGS, CHEMICALS, AND REGULATED GOODS
Certain products may be restricted or prohibited by carriers or government authorities.
Examples include:

Seatbelt pretensioners

Aerosols
-
Chemicals
-
Pressurized containers

Flammable products

Certain fluids

Dangerous goods
The customer must accurately disclose the goods being forwarded.
TRM may:

Require special packaging

Require a different carrier

Arrange lawful domestic return

Decline international transportation
TRM does not guarantee transportation of any regulated product merely because it was successfully shipped to TRM within the United States.
32. PROHIBITED OR UNLAWFUL GOODS
TRM will not knowingly forward goods that TRM reasonably believes:

Cannot lawfully be exported

Cannot lawfully be imported
-
Violate sanctions
-
Violate carrier restrictions
-
Require licenses that are unavailable
-
Present an unacceptable safety risk
-
Are unlawfully described or valued
TRM may require additional documentation before accepting such goods for international transport.
33. CUSTOMER DELAY
A shipment may be placed on hold where the customer fails to provide:

Accurate information

Return instructions

Shipping authorization

Other required cooperation
TRM is not responsible for delay resulting from the customer’s failure to provide required cooperation.
34. STORAGE
Goods requiring extended storage because of customer delay, payment delay, document delay, refusal to proceed, or other unresolved customer-side issues may become subject to reasonable storage charges after appropriate notice.
Storage is not intended to be a long-term warehousing service unless separately agreed.
TRM may take additional lawful action regarding long-term unclaimed goods as described in the Terms of Service.
35. FAILED OR REFUSED INTERNATIONAL DELIVERY
If an international shipment is:

Undeliverable

Returned to sender

Delayed because of an incorrect address

Held because of recipient non-cooperation

Returned because required charges were not paid

Returned after unsuccessful delivery attempts
the customer may be responsible, to the extent permitted by law, for resulting costs including:

A returned shipment does not automatically create a right to refund the goods or forwarding service.
36. TRANSPORT DAMAGE – CUSTOMER-SUPPLIED GOODS ARRIVING AT TRM
Where a customer purchased the goods independently from an external seller, loss or damage occurring before TRM receives the goods is generally a matter involving:

Inbound carrier
TRM is not the seller of Customer-Supplied Goods.
TRM may document visible external damage where reasonably practical.
TRM does not guarantee discovery of concealed damage.
The customer remains responsible for preserving and pursuing rights against the original seller or inbound carrier.
37. TRANSPORT DAMAGE – FORWARDING SHIPMENTS
International forwarding transportation is performed by independent carriers.
Customers must preserve:

Internal packaging

Shipping label

Photographs

Delivery documentation
where a transportation claim may be required.
Where the carrier permits the recipient to file a claim directly, the customer is responsible for pursuing the carrier claim.
Where TRM is the contractual shipper, carrier account holder, or the carrier requires the claim to be filed by TRM, TRM may submit or reasonably assist with the carrier claim after receiving the required evidence from the customer.
TRM does not guarantee:

Reimbursement amount

Reimbursement of the full purchase value

Reimbursement of duties

Reimbursement of taxes

Reimbursement of labor

Reimbursement of consequential losses
Assisting with a carrier claim does not constitute an admission that TRM caused the transportation damage.
TRM remains responsible for its own conduct only to the extent required by the applicable agreement and law.
38. DECLARED VALUE AND TRANSPORT INSURANCE
A customs value, commercial invoice value, or carrier declared value is not necessarily equivalent to full cargo insurance.
Separate transportation insurance or additional coverage applies only when expressly stated for the particular shipment.
Carrier reimbursement may be subject to:

TRM uses packaging considered reasonably appropriate for the applicable shipment and service.

TRM does not guarantee preservation of original seller packaging when repacking is reasonably required.
40. CUSTOMER-REQUESTED PACKAGING OR SHIPPING METHOD
A customer may request a particular:

TRM may decline a request that TRM reasonably considers unsafe, noncompliant, unavailable, or operationally inappropriate.
Where TRM accepts a customer-requested special service, additional charges may apply.
41. BUSINESS CUSTOMERS
For Business Customers, the following applies to the maximum extent permitted by law.
Transportation risk may transfer when goods are properly tendered to the carrier where the applicable commercial agreement or law permits.
Business Customers are responsible for promptly inspecting deliveries and preserving transportation claim evidence.
Carrier, freight, Incoterm, or risk-transfer terms expressly stated in a written B2B quote or agreement control where applicable.
TRM is not responsible to Business Customers for indirect business losses arising solely from carrier delay to the maximum extent permitted by the applicable agreement and law.
42. GERMANY CONSUMER SUPPLEMENT
ZUSATZBESTIMMUNGEN FÜR VERBRAUCHER IN DEUTSCHLAND
Dieser Abschnitt gilt zusätzlich für Verbraucher mit gewöhnlichem Aufenthalt in Deutschland, soweit der konkrete Vertrag unter zwingendes deutsches Verbraucherschutzrecht fällt.
Bei einem Widerspruch zwischen diesem Abschnitt und einer allgemeinen Regelung dieser Shipping Policy gilt gegenüber dem Verbraucher die zwingend erforderliche verbraucherschützende Regelung.
42.1 Unterschied zwischen Teilekauf und Forwarding
Für Deutschland ist ausdrücklich zwischen zwei Fällen zu unterscheiden:
A. TRM verkauft die Ware
Hat der Verbraucher die Ware von TRM gekauft, ist TRM Verkäufer.
Die gesetzlichen Rechte des Verbrauchers aus dem Warenkauf bleiben bestehen.
B. Kunde kauft die Ware selbst
Hat der Verbraucher die Ware selbst bei beispielsweise:

RockAuto
-
eBay
-
einem Hersteller
-
Händler
-
Verwerter
-
privaten Verkäufer
gekauft und nutzt TRM lediglich für den Weitertransport, ist der Drittanbieter Verkäufer der Ware.
TRM ist in diesem Fall Dienstleister für den vereinbarten Forwarding-Ablauf und übernimmt nicht die Verkäuferpflichten des Drittanbieters.
42.2 Versandrisiko bei von TRM verkaufter Ware
Bei einem Verbrauchsgüterkauf geht das Risiko des zufälligen Verlusts oder der zufälligen Beschädigung der Ware nicht allein deshalb auf den Verbraucher über, weil TRM die Ware einem von TRM angebotenen Versanddienstleister übergeben hat.
Das zwingende gesetzliche Gefahrtragungsrecht bleibt unberührt.
Dies gilt nicht zwingend in gleicher Weise, wenn der Verbraucher selbst einen Beförderer beauftragt, den TRM dem Verbraucher zuvor nicht angeboten oder benannt hat.
42.3 Forwarding-Ware ist anders zu behandeln
Bei selbst gekaufter Forwarding-Ware verkauft TRM das Teil nicht.
Probleme, die bereits vor Übergabe an TRM entstanden sind, insbesondere:

Verlust
-
Fehlversand
-
falsches Teil
-
beschädigte Eingangssendung
-
fehlende Teile
-
Verkäuferfehler
sind grundsätzlich gegenüber dem ursprünglichen Verkäufer oder dem für diese Eingangssendung verantwortlichen Carrier zu verfolgen.
Eine eigene Haftung von TRM für eine von TRM zu vertretende Pflichtverletzung bleibt unberührt.
42.4 Versandkosten und Zusatzkosten
Vor Abschluss eines Verbrauchervertrags werden dem Kunden die gesetzlich erforderlichen Informationen zu:

Lieferkosten
-
Frachtkosten
-
zusätzlichen Kosten
bereitgestellt.
Können bestimmte Kosten aufgrund der Beschaffenheit des Auftrags vernünftigerweise noch nicht im Voraus abschließend berechnet werden, wird darauf hingewiesen, dass weitere Kosten entstehen können beziehungsweise nach welcher Grundlage diese berechnet werden.
Bei Forwarding ist insbesondere zu berücksichtigen, dass die endgültige Sendung erst nach tatsächlichem Wareneingang und Verpackung vollständig vermessen werden kann.
42.5 Versandkostenrechner
Der öffentliche TRM-Versandrechner ist eine unverbindliche Planungshilfe.
Die dort angezeigten Werte beruhen insbesondere auf den vom Kunden eingegebenen Daten.
Der verbindliche Betrag kann erst auf Grundlage der für den konkreten Auftrag maßgeblichen Daten bestimmt werden.
Dazu gehören insbesondere:

tatsächliches Gewicht;
-
endgültige Außenmaße;
-
Anzahl der Packstücke;
-
Verpackung;
-
Zolltarifnummer;
-
Ursprungsland;
-
Warenwert;
-
Carrier-Tarif;
-
Zuschläge;
-
Importkosten.
42.6 DDP / verzollte Lieferung
Wird dem Verbraucher für einen konkreten Auftrag ausdrücklich eine DDP- beziehungsweise Duty-Paid-Lieferung angeboten und bestätigt, organisiert TRM die Sendung auf dieser Grundlage.
Dies bedeutet nicht, dass TRM die Entscheidungshoheit der Zollbehörden übernimmt.
Die zuständigen Behörden können insbesondere:
-
Unterlagen anfordern;
-
eine Ware prüfen;
-
eine Tarifnummer ändern;
-
den Ursprung anders bewerten;
-
den Zollwert prüfen;
-
zusätzliche gesetzliche Abgaben festsetzen.
TRM haftet nicht allein deshalb für eine behördliche Neubewertung, sofern TRM die ihm obliegenden Pflichten ordnungsgemäß erfüllt hat.
42.7 Lieferzeit
Angaben zu Laufzeiten von DHL oder anderen Carriern sind grundsätzlich Carrier-Laufzeitangaben beziehungsweise Schätzungen, sofern TRM nicht ausdrücklich einen verbindlichen Liefertermin zugesagt hat.
Zwingende gesetzliche Rechte wegen verspäteter Lieferung bleiben unberührt.
42.8 Transportschaden bei von TRM verkaufter Ware
Hat TRM die Ware an den Verbraucher verkauft, wird das gesetzliche Versandrisiko nicht durch diese Policy auf den Verbraucher verlagert.
Der Verbraucher sollte dennoch Schäden unmittelbar dokumentieren und TRM informieren.
Insbesondere sollten aufbewahrt werden:
-
Verpackung
-
Label
-
Fotos
-
beschädigte Ware
-
Zustelldokumente
damit TRM gegenüber dem Carrier regressieren oder eine Carrier-Reklamation durchführen kann.
Der Verbraucher muss einen gesetzlichen Anspruch gegen TRM nicht dadurch verlieren, dass der Carrier die eigene Reklamation ablehnt.
42.9 Transportschaden bei Forwarding-Ware
Bei einer Forwarding-Sendung kann der internationale Transport einer vom Kunden selbst gekauften Ware Gegenstand eines eigenständigen Transport- beziehungsweise Forwarding-Vertrags sein.
Der Kunde muss Transportschäden unverzüglich dokumentieren und die erforderlichen Nachweise erhalten.
Kann der Empfänger nach den Carrier-Bedingungen selbst einen Anspruch geltend machen, ist der Kunde für die direkte Carrier-Reklamation verantwortlich.
Kann eine Reklamation nur durch TRM als registrierten Versender oder Account-Inhaber eingereicht werden, wird TRM die Reklamation nach Bereitstellung der erforderlichen Unterlagen einreichen oder angemessen unterstützen.
TRM garantiert keine bestimmte Carrier-Entschädigung.
42.10 Mangel an von TRM verkaufter Ware
Transportbedingungen und Carrier-Regeln beschränken nicht die zwingenden gesetzlichen Mängelrechte des Verbrauchers gegenüber TRM, wenn TRM Verkäufer der Ware ist.
Soweit TRM im Rahmen einer gesetzlichen Nacherfüllung erforderliche Transportkosten zu tragen hat, werden diese nach den gesetzlichen Vorgaben behandelt.
42.11 Mehrere Pakete
Eine Bestellung kann in mehreren Paketen eintreffen oder weitergesendet werden.
Insbesondere beim Forwarding kann ein einzelner Einkauf des Kunden:
-
mehrere Verkäuferlager;
-
mehrere Trackingnummern;
-
mehrere Eingangskartons
umfassen.
TRM kann diese Sendungen im Rahmen eines Forwarding-Auftrags gemeinsam verwalten, soweit dies nach dem vereinbarten Ablauf vorgesehen ist.
Eine Zusammenlegung in einen einzigen Versandkarton wird nicht garantiert.
42.12 Umpacken und Konsolidieren
Der Verbraucher gestattet im Rahmen des ausdrücklich beauftragten Forwarding-Services das zur Durchführung der Leistung erforderliche:

Öffnen;
-
Prüfen;
-
Fotografieren;
-
Vermessen;
-
Wiegen;
-
Umpacken;
-
Zusammenfassen;
-
Trennen;
-
Verstärken;
-
Palettieren;
-
Verpacken.
TRM entscheidet nach pflichtgemäßem Ermessen, ob eine Konsolidierung sicher und transportgeeignet ist.
Sicherheit geht vor einer Reduzierung der Paketanzahl.
42.13 Große und gebrauchte Komponenten
Motoren, Getriebe, Achsen und vergleichbare Komponenten können zusätzliche Anforderungen an:

Reinigung;
-
Flüssigkeitsfreiheit;
-
Verpackung;
-
Palette;
-
Kiste;
-
Sicherung;
-
Carrier-Freigabe
stellen.
Zusatzmaßnahmen und zusätzliche Kosten werden behandelt, wie es nach dem konkreten Vertrag und zwingendem Recht erforderlich ist.
42.14 Fehlerhafte Kundendaten
Der Kunde muss wahrheitsgemäße und vollständige Angaben machen.
Entstehen zusätzliche Kosten aufgrund nachweislich falscher oder wesentlich unvollständiger Kundenangaben, kann der Kunde dafür verantwortlich sein, soweit dies gesetzlich zulässig ist.
Dies gilt insbesondere bei bewusst falschen Angaben zu:

Warenwert;
-
Inhalt;
-
Menge;
-
Ursprung;
-
Gefahrguteigenschaft;
-
Adresse.
42.15 Keine freiwillige Übernahme von Carrier- oder Behördenrisiken
TRM übernimmt gegenüber einem deutschen Verbraucher nur:
-
die ausdrücklich vereinbarten Verpflichtungen; und
-
diejenigen Pflichten, die nach zwingendem Recht bestehen.
Die Nutzung eines bestimmten Carriers, die Erstellung von Zolldokumenten oder die Unterstützung bei einer Reklamation stellt keine freiwillige Garantie für:
-
Zustellung zu einem bestimmten Zeitpunkt;
-
Zollfreigabe;
-
Anerkennung eines Claims;
-
Höhe einer Carrier-Erstattung;
-
bestimmte Behördenentscheidung
dar.
43. FORCE MAJEURE AND EVENTS OUTSIDE TRM’S REASONABLE CONTROL
To the extent permitted by applicable law, TRM is not responsible for delay or nonperformance caused by events reasonably outside TRM’s control.
Examples include:

Natural disasters

War
-
Civil unrest
-
Government action
-
Customs closure
-
Border closure
-
Airport disruption
-
Carrier system outage
-
Strike
-
Cyberattack
-
Supplier interruption
-
Sanctions
-
Transportation embargo
-
Comparable events
Mandatory customer rights remain unaffected.
44. RELATIONSHIP TO OTHER POLICIES
Returns and refunds are governed by the Return and Refund Policy.
Contract formation, liability, forwarding-service terms, storage, customer-supplied goods, and other contractual matters are also governed by the Terms of Service.
Where a transaction-specific written quote or agreement contains a more specific shipping term, that term applies to the extent legally permitted.
45. POLICY CHANGES
TRM may update this Shipping Policy prospectively to reflect changes in:

Carrier relationships
-
Shipping methods
-
International services
-
Operational procedures
-
Legal requirements
The version properly applicable to an existing transaction remains subject to applicable contractual and legal requirements.
